Due to its potentially addictive qualities, cannabis, commonly known as marijuana, has been subjected to strict regulations in numerous countries, extending to its derived products. One such product is Cannabidiol, often referred to as CBD.

CBD, the second most abundant active compound in cannabis (marijuana), serves as a crucial component of medical marijuana. It is either extracted from the hemp plant, a close relative of marijuana or synthesized in a laboratory.

Unlike typical drugs, CBD is commonly used as a supplement, and despite being derived from the cannabis plant, it surprisingly lacks psychoactive effects, meaning it does not induce a “high” on its own.

In contrast to CBD, THC, another compound found in cannabis, operates differently. Tetrahydrocannabinol (THC) is the primary psychoactive component in marijuana, hashish, and other cannabis-derived preparations, particularly those from Cannabis sativa or synthesized sources.

THC interacts with receptors in the human brain and nervous system, leading to sensations of lightheadedness, commonly known as being “high.”

One key driver is the increasing legalization of CBD products across various European countries. The EU’s decision in 2020 to classify CBD as non-narcotic has played a pivotal role in this trend. This legal clarification has significantly boosted the sales of CBD products, encompassing cosmetics, recreational usage, and medicinal applications, among others.

Regulatory Framework for Medical Cannabis in Nigeria

In Nigeria, while the Indian Hemp Act of 1966 prohibits the planting, cultivation, and importation of Indian hemp with severe penalties, Section 12 of the Dangerous Drugs Act of 1935 allows the importation of Medicinal Cannabis under specific conditions set by the Minister of Health.

The National Agency for Food and Drug Administration (NAFDAC) is the primary regulatory authority for food and drug products, including medical cannabis. NAFDAC has control over various aspects of medical cannabis, and companies need their approval to sell CBD products in Nigeria.

The National Drug Law Enforcement Agency (NDLEA) and the Federal Ministry of Health also play roles in regulating cannabinoid drugs. Several Acts and Regulations, like the Indian Hemp Act of 1966 and the Dangerous Drugs Act of 1935, govern the use, distribution, and sale of these substances.

In summary, medical cannabis is legal in Nigeria for medicinal purposes, subject to strict regulations. Importation of cannabinoid drugs requires a license from the Minister of Health, and CBD products must be registered with NAFDAC before they can be manufactured, imported, advertised, sold, or distributed in the country.

Nigeria lags significantly in CBD market development compared to Europe and North America, primarily due to its stringent cannabis-related legislation.
